Welcome and Acceptance of Terms of Use
Welcome to Pebble POS, an Apption company. Pebble POS is operated by APPTION LLC (“Apption,” “we,” “us,” “our”), formed on April 25, 2022, and registered at 8600 Freeport Pkwy, Ste 130, Irving, TX 75063.

By accessing Pebble POS services (the “Services”), including our point-of-sale system, website, mobile application, and other related digital interfaces, you acknowledge your agreement to these Terms of Use. These Terms outline your rights and obligations when using our Services.

We may update these Terms periodically. Your continued use of the Services after such updates indicates acceptance. If you do not agree, please discontinue use of our Services.

Important: Sections such as “Binding Arbitration” and “Class Action Waiver” affect your legal rights. Please review them carefully.

Description of Services

Pebble POS provides restaurants with point-of-sale software, marketing tools, analytics, automation, and communication utilities.

Pebble POS itself does not sell, prepare, or deliver food and beverages — those responsibilities remain with the restaurant or third-party provider.

Our Services may integrate third-party features, including:

  • Payment services – subject to their own terms.
  • Delivery platforms – such as DoorDash or others, with their own conditions.
  • Google Maps API – by using our Services, you agree to the Google Maps API Terms of Service.

Community Guidelines

We require all users to follow these rules:

  • Do not use the Services for unlawful, fraudulent, or harmful purposes.
  • Do not impersonate others or misrepresent affiliations.
  • Do not disrupt, exploit, or attempt unauthorized access to the Services.

Violation of these rules may result in suspension or termination of your access.

Age and Usage Restrictions

Users must meet the minimum legal age requirements in their jurisdiction to use the Services. Restaurants may also set additional age or order restrictions. For alcohol-related sales, local drinking-age laws apply, with ID verification required.

Membership and Fees

Membership fees and subscription charges are based on Pebble POS pricing guidelines. Fees are billed in advance for the Subscription Term, are non-cancellable, and are non-refundable unless otherwise specified.

Billing, Payment, and Refunds

You authorize Apption (Pebble POS) to charge your chosen payment method for all applicable fees, taxes, and charges.

  • All payments are final and non-refundable, except where expressly stated.
  • Marketplace or integrated order fees may include additional charges.
  • Refunds for restaurant orders are subject to the individual restaurant’s refund policies. Pebble POS may facilitate communication but is not obligated to issue refunds directly.
  • We comply with PCI-DSS standards for secure payment processing.

Account Registration and Security

When registering for a Pebble POS account, you must provide accurate information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

Apption reserves the right to suspend or terminate accounts for violations.

Intellectual Property

All content, trademarks, service marks, software, and design elements within Pebble POS Services are the property of Apption LLC or licensed third parties.

You are granted only limited rights to use the Services as authorized under these Terms. Unauthorized reproduction, modification, or commercial use is strictly prohibited.

User Submissions and Communications

By submitting feedback, suggestions, or content through Pebble POS, you grant Apption a non-exclusive, worldwide, royalty-free, perpetual license to use such submissions for business purposes.

No Warranties / Limitation of Liability

The Services are provided “as is” and “as available.” Apption disclaims all warranties, express or implied, including merchantability, fitness for purpose, or non-infringement.

Apption is not responsible for:

  • Issues with food or delivery (these remain between you and the restaurant).
  • Service interruptions, data loss, or errors.
  • Any damages exceeding the amount you paid for the Services in the past three (3) months.

Dispute Resolution

Binding Arbitration & Jury Waiver
Disputes will be resolved by binding arbitration under the Federal Arbitration Act (FAA). By agreeing, you waive your right to jury trial.

Class Action Waiver
Claims must be brought individually and not as part of a class or collective action.

Indemnification

You agree to indemnify and hold Apption harmless against claims, damages, or expenses arising from your misuse of the Services or violation of these Terms.

Termination

Apption may suspend or terminate your access to Pebble POS at its sole discretion, without prior notice, for violations of these Terms or other reasons.

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Texas, United States. Legal proceedings shall be brought exclusively in courts located in Dallas, Texas.

Changes to Services and Terms

Apption reserves the right to update or discontinue Services and to modify these Terms at any time. Updates are effective upon posting. Continued use indicates acceptance.

Miscellaneous

  • No waiver – Failure to enforce any provision does not constitute a waiver.
  • Severability – If part of these Terms is invalid, the remainder remains enforceable.
  • Entire Agreement – These Terms, along with related policies, form the entire agreement between you and Apption regarding Pebble POS.
